Avaesvo Bakkie Hire Terms & Conditions

Terms & Conditions governing the Hiring of a Vehicle from AvaEsvo (hereinafter referred to as the “Owner”) by the Hirer (hereinafter referred to as the “Hirer”).

1. HIRE RATES & PAYMENT TERMS

R 1000 Security Deposit and Rental to be paid upfront before collection.

In general, full, and final amounts of vehicle hire and security deposits need to be paid up front in full before the hire takes place.

Payment to be made by EFT or in cash at least 24 hours before commencement of hire period. If by EFT then payment must reflect as a cleared credit in our bank account before hire commences. Proof of Payment alone is not accepted. Cheques will not be accepted unless prior arrangements are made.

Long distance rentals need to be negotiated in advance and the local rates do not apply.

Deposits must be collected on return of the Bakkie – T&Cs apply. Cancellations will incur a Cancellation Processing Fee of R300

NO 24 HR BILLING. Usage fee ( Hire fees) between our daily business hours apply.

The vehicle must be returned in a clean and acceptable condition, if returned dirty a Cleaning Fee of R 200 applies.

A daily kilometre allowance is included in hire rate. Thereafter, kilometres recorded in excess of the daily allowance will be charged in addition. (see Bakkie Hire page for details)

2. TRAFFIC OFFENCES

Hirer is fully responsible for any traffic fines, or any other offence committed during the period of Hiring the Vehicle.

3. VEHICLE CONDITION

The Hirer will have the opportunity to inspect the vehicle before hiring and to satisfy him/herself that it is in good operating and general condition. Any defects noted must be recorded by AvaEsvo responsible staff before the hire commences and verified by signature of both staff and Hirer.
Hirer is fully responsible for any damages to the vehicle through collision or any other cause whatsoever.

Whilst normal wear is anticipated any damages to the tyres are the sole responsibility of the Hirer.

4. GEOGRAPHICAL LIMITATIONS OF USE

Strictly no cross-border use. All rates given are for local use only. Our understanding for local use is within the boundaries of the City of Cape Town.

5. VEHICLE INSURANCE

Insurance coverage is provided for the Vehicle under this Agreement. In the event of accident damage or theft of the vehicle the first R 6900, being the Insurance Excess Amount, of repair cost incurred will be for the account of the Hirer.

6. DAMAGE OR LOSS

As permitted given the extent of the law, the Hirer will be responsible for risk of theft, damage, loss, or destruction of the Vehicle from any and every cause. In the event of an insurance claim for damage repair or total loss being rejected by the insurer, the Hirer agrees to pay for any and all costs of repair, up to the current value of the Vehicle. If while in the Hirer's possession, the Vehicle becomes lost, and the insurance claim is rejected, the Hirer agrees to pay the Owner its current value.

In all events, the first R 6900 of any insurance claim for damage repair or total loss, being the Insurance Excess Amount, will be payable by the Hirer. Mechanical damage to engine or other components is not covered by insurance and repair costs will be for the account of the Hirer.

7. LATE RETURNS / AFTERHOURS RETURNS

Late Returns / Afterhours Returns will be levied at R 50 late fees. Returns after 9 AM the following day will be levied the full Hire fees for the Business days, until such time as the vehicle is returned (pre-arrangements will be considered).

The Owner is also authorised to subtract these charges from the security deposit (if applicable).

8. RESPONSIBILITIES OF THE HIRER

The Hirer agrees not to allow any other person to drive the vehicle, except for authorized drivers listed and approved by prior arrangement.

The Hirer agrees to hold harmless, indemnify, and release the Owner for any damages, injuries, property loss, or death caused while the Hirer operates this vehicle. Hirer is to supply his/her own fuel and to ensure that the correct fuel only is used. Use of any unsuitable fuel will result in repair charges being levied.

The Hirer swears and attests that he/she has a legal, valid license to drive this type of vehicle in South Africa, and that there are no outstanding warrants against said license.

9. WHOLE AGREEMENT

These Terms and Conditions together with our quotation are intended to form the whole agreement between us and to prevail over any verbal discussions. Should we mutually agree to any variation of these terms such variation should be confirmed in writing. Any variation however agreed shall never invalidate the remainder of these Terms and Conditions.

10. JURISDICTION

This contract/agreement is subject to the laws of The Republic of South Africa.
